Holiday Sickness

You've checked in online, the suitcases are packed, the out of office is on and you are soon to be jetting off on a holiday that you've spent months saving up for. You arrive at the hotel abroad and after a few nights you feel sick, have abdominal pains, vomiting and diarrhoea. You are confined to your bed and the holiday is ruined. The symptoms you are experiencing could be due to the fact you have contracted Salmonella, Typhoid, Campylobacter, EColi, Gastroenteritis or Clostridium Difficile. In more serious cases, these symptoms can lead on to irritable bowel syndrome and sometimes even death.

Sickness on holiday often occurs as a result of food poisoning caused by careless and incorrect food handling , food that is served only luke-warm and has been left standing for some time and food that has been contaminated by pests such as flies and birds. It is often the case that claimants report a smell of sewage around the grounds, flies around the buffet and dirty pool areas.

If you are on a package holiday then your tour operator is responsible for ensuring that the food you eat is safe to do so and that you don't suffer illness as a result of poor hotel conditions. If you have suffered an illness as a result of poor hotel conditions whilst on a package holiday in the last two years then you may be able to claim some compensation for the illness suffered and the lost enjoyment of your holiday.

In order to successfully bring a claim then you must satisfy certain criteria;

You must have been on a packaged holiday provided by a tour operator with some form of food provided by the hotel.

You must have visited a doctor or pharmacy while on holiday.

You must have complained to a memeber of staff and had your complaint logged.

You must have been to the doctors within a week of returning home.

At McHale & Co Solicitors, we can also help with other holiday issues, such as ear/throat infections caused by dirty swimming pools, accidents while in the hotel or out on excursion, or flight/transfer collisions and delays.
