Solicitors – Do I have a choice?

Many people are unaware that they have a right to instruct a Solicitor of their choice to represent them in pursuing their claim for compensation.  It does not matter what type of personal injury claim it is, be it industrial disease, clinical negligence, road traffic accident or an accident at work, you have a legal right to elect a Solicitor of your choice.

The same applies even if you are part way through a claim.  If you feel let down by your current Solicitor, you are well within your rights to transfer your file to another firm of Solicitors.  Often it is the case that clients feel that their Solicitor isn’t progressing matters, they are unhappy with the service or they are not being kept updated about the development of their claim.  It is entirely reasonable for you to transfer the file to another firm of Solicitors and not have to pay for the privilege.  In these situations, the file from the previous Solicitor is transferred to the new Solicitor and the costs are dealt with upon conclusion of the case.  You do not need to pay your previous firm anything and you do not even have to discuss the matter with them once the file has been transferred.

Personal Injury claims are complex matters.  When considering changing your Solicitor, it is important you carry out research to ensure that your new Solicitor is capable of dealing with such complexities and has experience in this area of law.  Here at McHale & Co we have a dedicated, professional personal injury department who are committed to providing an excellent service.   If you are unhappy with your current Solicitors, please do not hesitate to call us on 0161 928 3848 or email  We are an APIL accredited Practice and are one of only a few hundred in the country who have achieved this specialist status.
