Professional Negligence Claim

McHale and Co Solicitors Altrincham have just completed a professional negligence claim against another leading Manchester firm.

The previous firm had made an offer to settle the claim in the sum of £10,000 and had not withdrawn it when further medical evidence was received. That further evidence suggested that a higher figure may be appropriate once appropriate questions were raised of the specialist who had indicated that her condition of fibromyalgia may be accident related. The defendants on the original action accepted the offer of £10,000 and the claimant was potentially left short.

McHale and Co were instructed in April 2015, asked the appropriate questions of the specialist and then negotiated a settlement of £35,500 including costs in addition to interim payments of nearly £7,000. Settlement was achieved on 10th August 2015 less than 4 months post instruction.

Malcolm Horner, Head of Personal Injury at McHale and Co says ‘I am pleased with this settlement for the client. My colleague Matt Bell and I managed to secure a speedy settlement against a leading Manchester firm of solicitors. I believe, unfortunately, that negligence claims will become more common with all the new legislation and pressures on solicitors. With large workloads simple mistakes can be made. Fortunately all solicitors firms are insured for such negligence’.
