Filtering accident cases are notorious for settling poorly: the other parties are always going to argue contributory negligence; they’re always going to try to blame the bike rider in some way to lower their own payout.
With the right combination of legal expertise and biking knowledge on your side though, things can be different.
We acted for a biker who was riding through Central London, filtering past traffic near Hyde Park. Three other bikers were in front of them and had safely made it past a nearby car driver, but as our client went to make the same move the car driver swerved right with no indication, causing an accident and injury to our biker.
Seems like an open and shut case doesn’t it? You’d be surprised how often even simple cases like this end up with a shared payout, but we achieved a 100% payout for our client based on three main factors:
- The speed our biker was travelling at
- The lack of indication from the car driver
