The local council initially denied liability stating that the council had regularly inspected the area and when last inspected there were no defects (s58 Highways Act defence).
Statements were obtained from local residents confirming the defect in question had been there for years!
Medical reports were commissioned from orthopaedic and other experts and a care report was obtained producing a 6 figure schedule and following a conference with counsel settlement was achieved in sum of £90,000 after previous lower offers. The claimant was very happy with the settlement.
Don’t always take the council’s first response on liability or quantum. Evidence can be obtained to defeat them on occasions!
