For several years our Head of Clinical Negligence, Nimish Patel, has been instructed on behalf of a Claimant who had pre-existing heart problems when she suffered a minor stroke which was not properly diagnosed or treated before she commenced IVF treatment.  As the Trust had failed to consider the pre-existing issues, the Claimant was vulnerable to a further stroke which she suffered during her pregnancy before giving birth to her son, suffering left sided paralysis.

The family have spoken about how he has been extremely supportive of them whilst they have been coming to terms with the diagnosis. He has assisted them with finding CBT treatment. Additionally, Mr Patel aided in considerations of the extent that she was able to continue with her employment whilst investigating the claim in relation to the steps that the Trust ought to have taken.

We managed to resolve a dispute between our own experts in relation to the nature of the aneurysm and whether it had been foreseeable and then presented the evidence to the Defendants and managed to negotiate an agreement on liability in favour of the Claimant which exceeded Counsel’s advice on prospects. The Claimant has received an award of over £1million which has started to ease this young family’s debts and can be put towards assistance for her in her home as well as any further physio to develop her both physically and mentally.
