I noted with interest that the TV programme HIGNFY captain Ian Hislop sustained injuries due to being struck by an electric bike whilst crossing the road.
I successfully claimed life changing damages for a client this year. He was on his electric bike when struck by a motor vehicle. He was hospitalised for some time and the defendant insurance company settled pre-litigation for a sum enabling the client to set himself up in business and secure his future.
Although the highway code is silent on escooter use, one would argue that the liability is similar to pedal cycles thus priority should be given by other motor vehicles, which was our argument in the negotiations. The driver’s insurance company accepted liability rather quickly faced with the arguments
I would be delighted to represent in addition to escooter drivers pedestrians like Mr Hislop if the escooter was at fault too. Many cities have extended pilot schemes whilst the government assess whether to allow them nationwide. If one is injured in a pilot area then there will be insurance in place to compensate for injuries.
