Landlord and Tenant – Negotiated Resolution

Our client was a private individual who had rented out a residential property by way of an assured shorthold tenancy and managed by a letting agency. The full term of the tenancy had come to an end and he wished to sell the property with vacant possession.

We dealt with all the legal aspects of the case for the client, liaising with the letting agency to ensure that the client’s legal position was secure before serving the relevant notices and then issuing proceedings.

Although the claim for possession was initially vigorously defended, our thorough and detailed preparation of the evidence in the case enabled us to successfully negotiate with the tenant’s legal team so that the tenant gave up possession to our client without the need for a trial, avoiding additional delay, stress and expense for our client.

Based on the former tenant’s conduct in the possession proceedings, we also anticipated and immediately successfully dealt with an unfounded allegation of disrepair which was made after the proceedings had concluded.
