Head of PI and Clinical Negligence

Nimish Patel is a personal injury solicitor specialising in clinical negligence with experience over twenty years. He is the Head of Personal Injury and Clinical Negligence claims, as well as a qualified Workplace mediator and trainer.

Throughout his career, he has demonstrated a commitment to reaching the highest levels of client care and going above and beyond what his role requires to ensure that every argument has been rehearsed and anticipating challenges. Attention to detail is apparent in every case that he takes on, within a wealth of experience in complex high- profile cases.

He was successful at the Court of Appeal case of Aktas v Adepta ( 2010) which established a legal principle in relation to issuing proceedings and was a Finalist for Clinical Negligence Lawyer of the Year at the Claims Media Awards in 2021 and 2023 , also he has been recommended within the Legal 500 previously.

He has also been involved in two group litigation settlements where it was necessary to manage the expectations of over a hundred Claimants with differing issues arising from the same exposure. Both claims required analytical skill as well as significant patience to explain individual variations of the settlements and has received great feedback.

Nimish was involved in a case for several years on behalf of a Claimant with cerebral palsy since birth, who turned 18 but still did not have capacity to bring the claim himself.  The Trust disputed liability for over 5 years and both parties had instructed five experts each from various disciplines.  Having co-ordinated the reports and assisted Counsel for a round table discussion which resulted in an agreement on liability to reflect the uncertainty in relation to when the decisive event occurred, a gross agreement was finally reached in the sum of just over £15 million.

He worked with the family to organise suitable arrangements for the Claimant’s benefit following the agreement and interim payment, as well as consideration for the Claimant’s parents to have respite from lifelong struggles. He has managed to organise for the family to buy their own house so that they have security for the future and  planned for the future involving seven different disciplines of experts for both sides in order to consider his immediate and long term needs.

He has been instructed on behalf a Claimant who had pre-existing heart problems when she suffered a minor stroke which was not properly diagnosed or treated before she commenced IVF treatment.  As the Trust had failed to consider the pre-existing issues, the Claimant was vulnerable to a further stroke which she suffered during her pregnancy before giving birth to her son, suffering left sided paralysis. He has been extremely supportive of the  family  whilst they have been coming to terms with the  diagnosis, assisting with  finding CBT treatment and consideration of the  extent that she was able to continue with her  employment whilst investigating the claim in relation to the steps that the Trust ought to have  taken and resolving a dispute between our own experts in relation to the nature of the  aneurysm and whether it had been foreseeable.

He enjoys helping clients to achieve recognition that their injury or condition has been caused because their employer or medical professional has not undertaken their duty to assess risks and taken the necessary action to protect them from harm.

Nimish is a keen follower of Manchester United and Sale Sharks, attending games for both as much as possible. He is a Sale Sharks DPP coach developing players at U14 and U15 level having coached club sides for fifteen years and is a qualified rugby referee. He enjoys watching most other sports having tried to play most of them himself in younger days! He has been married for 20 years and has three sons.
